(Announcement on the Phytosanitary Requirements for Import of Fresh Jackfruits from the Lao People’s Democratic Republic)

In accordance with the relevant laws and regulations of the People's Republic of China and the provisions of the phytosanitary requirements for the export of fresh jackfruits from the Lao People's Democratic Republic (hereinafter referred to as "the Lao side") to China agreed between the General Administration of Customs of the People's Republic of China (hereinafter referred to as "the Chinese side") and the Ministry of Agriculture and Environment of the Lao People's Democratic Republic, import of fresh jackfruits from Laos that meet the following relevant requirements is permitted with immediate effect.

I. Phytosanitary Basis

1. The Biosecurity Law of the People's Republic of China;

2. The Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine and its implementing regulations;

3. The Food Safety Law of the People's Republic of China and its implementing regulations;

4. The Administrative Measures for Inspection and Quarantine of Imported Fruits;

5. The Protocol on Phytosanitary Requirements for the Export of Fresh Jackfruits from the Lao People's Democratic Republic to China between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Environment of the Lao People's Democratic Republic.

II. Name of Permissible Import Commodity

Fresh jackfruit (hereinafter referred to as jackfruit), scientific name: Artocarpus heterophyllus, English name: Jackfruit.

III. Permissible Origin

Jackfruit producing areas in Laos.

IV. Approved Orchards and Packaging Plants

Orchards and packaging plants exporting jackfruits to China shall be audited by the Lao side and registered upon approval by the Chinese side. Registration information including name, address and registration number shall be retained to ensure accurate traceability for any non-compliant export consignments. The Lao side shall submit the list of registered orchards and packaging plants to the Chinese side, which will be reviewed, approved, published and regularly updated on the official website of the General Administration of Customs.

VI. Pre-export Management

1. Orchard Management

(1) All orchards exporting jackfruits to China shall establish sound quality and traceability management systems under the supervision of the Lao side, implement Good Agricultural Practices (GAP), and maintain standardized orchard sanitation by eliminating production pollution sources and timely removing damaged, fallen and rotten fruits. Orchards shall implement Integrated Pest Management (IPM), covering regular pest monitoring, physical, chemical and biological prevention and control, and standardized agricultural operations.

(2) In accordance with ISPM 6, the Lao side shall formulate targeted pest management plans and conduct routine orchard monitoring for all quarantine pests of concern to China. Bactrocera umbrosa shall be monitored via pheromone traps and yellow sticky traps; Aleurodicus dispersus via insect traps or yellow sticky traps. Scale insect monitoring shall be conducted at least once every 15 days from flowering to harvest to inspect pests on fruits, stems and leaves.

(3) Where pests or pest symptoms are detected, comprehensive physical, chemical and biological control measures shall be adopted to ensure exported jackfruits are free from targeted quarantine pests. All control measures shall be approved by the Lao side and submitted to the Chinese side for review prior to trade commencement.

(4) All pest monitoring and control activities shall be conducted under the guidance of professionally trained technicians certified by the Lao side or its authorized institutions.

(5) The Lao side shall keep complete monitoring and control records and provide such documents to the Chinese side upon request, including full details of agrochemicals applied during the growing season such as name, application date, active ingredient and concentration.

2. Packaging Plant Management

(1) The processing, packaging, storage and shipment of export jackfruits shall be conducted under the official quarantine supervision of the Lao side or its authorized officials.

(2) Approved packaging plants shall maintain hygienic conditions with hardened floors and be equipped with independent raw material yards and finished product warehouses.

(3) Functional zones for storage, processing and packaging shall be independently arranged with reasonable layout and effectively isolated from staff living areas.

(4) During packaging, jackfruits shall be manually sorted, graded and cleaned to remove diseased, insect-infested, rotten and malformed fruits, as well as branches, leaves, soil and other plant residues. High-pressure air or water washing shall be applied, with manual wiping permitted when necessary to eliminate surface insects, eggs, pathogen spores and contaminants.

(5) Packaged jackfruits for storage shall be immediately placed in independent warehouse areas to avoid secondary pest infestation.

(6) Registered packaging plants shall establish a full traceability system covering processing date, source orchard name or registration number, quantity, export date, shipment volume, destination country and container number to ensure full orchard traceability.

3. Packaging Requirements

(1) All packaging materials shall be clean, unused and compliant with China’s phytosanitary and sanitary standards. Wooden packaging shall comply with ISPM 15 requirements.

(2) Each package shall be marked in Chinese or English with traceable information including fruit type, variety, exporting country, origin, and orchard/packaging plant name or registration number. All packages and pallets shall be clearly marked with "Exported to the People’s Republic of China".

(3) Shipping containers shall be inspected for sanitation before loading and officially sealed. Container seals shall remain intact upon arrival at Chinese entry ports.

4. Pre-export Inspection and Quarantine

(1) Within two years after the Protocol enters into force, the Lao side shall conduct 2% sampling inspection per batch, with full inspection for batches of fewer than 100 fruits. All suspicious fruits shall be dissected and examined. The sampling ratio may be reduced to 1% if no phytosanitary non-compliance occurs within the two-year period.

(2) Any batch detected with targeted live quarantine pests, plant residues or soil shall be prohibited from export to China. Relevant orchards or packaging plants may have their export qualification suspended for the rest of the export season. The Lao side shall investigate causes, take corrective measures and retain inspection records for submission to the Chinese side upon request.

5. Phytosanitary Certificate Requirements

(1) Qualified consignments shall be issued with an official phytosanitary certificate by the Lao side, indicating the name or registration number of the source orchard and packaging plant, with the additional declaration: "This consignment complies with requirements specified in the Protocol of Phytosanitary Requirements for Export of Fresh Jackfruits from Lao PDR to China, and is free from any quarantine pests of concern to China."

(2) Prior to trade launch, the Lao side shall submit the phytosanitary certificate specimen to the Chinese side for confirmation and filing.

VII. Entry Inspection, Quarantine and Disposal of Non-compliant Goods

All Lao jackfruit consignments arriving at Chinese entry ports shall be subject to inspection and quarantine by China Customs in accordance with the following provisions.

1. Verification of Certificates and Marks

(1) Verify the validity of the Entry Animal and Plant Quarantine License.

(2) Verify compliance of the phytosanitary certificate with the provisions of Item 5, Section VI herein.

(3) Verify compliance of package and wooden packaging marks with the provisions of Item 3, Section VI herein.

2. Entry Inspection and Quarantine

(1) Import jackfruits shall enter China via ports approved by the Chinese side for fruit import.

(2) Customs shall verify all documents and marks and conduct on-site inspection and quarantine in accordance with Chinese laws, regulations, national standards and this Announcement. Qualified goods shall be granted entry.

3. Disposal of Non-compliant Goods

(1) Consignments from unregistered orchards or packaging plants shall be denied entry.

(2) Consignments detected with live targeted quarantine pests, new Lao quarantine pests, soil or plant residues shall be returned, destroyed or disinfected.

(3) Consignments failing to meet China’s food safety laws, regulations and standards shall be returned or destroyed.
